Типові порушення у сфері публічних закупівель: необхідність посилення контролю

Abstract

UK: Прозорість використання публічних коштів є неодмінною ознакою демократичної держави, особливо в умовах децентралізації влади. У сучасному українському суспільстві формується потреба у систематичному та аргументованому аналізі використання державних ресурсів. Однією з найбільш гострих сучасних проблем в Україні є питання щодо здійснення контролю у сфері публічних закупівель, особливо в умовах здійснення сучасних електронних закупівель. Для того щоб подолати корупційні схеми під час здійснення закупівель у державній сфері, було прийнято рішення про впровадження переходу на електронний документообіг за допомогою системи електронних торгів, яка дістала назву “ProZorro”. Старі форми та методи контролю стають недієвими. Моніторинг закупівель дає можливість відстежувати процедури закупівель на будь-якому етапі їх здійснення. Отже, дослідження типових порушень у сфері публічних закупівель та методів їх виявлення є досить актуальними.

RU: Прозрачность использования публичных средств является непременным признаком демократического государства, особенно в условиях децентрализации власти. В современном украинском обществе формируется потребность в систематическом и аргументированном анализе использования государственных ресурсов. Одной из наиболее острых современных проблем в Украине является вопрос об осуществлении контроля в сфере публичных закупок, особенно в условиях осуществления современных электронных закупок. Для того чтобы преодолеть коррупционные схемы при осуществлении закупок в государственной сфере, было принято решение о внедрении перехода на электронный документооборот с помощью системы электронных торгов, получившей название “ProZorro”. Старые формы и методы контроля становятся недееспособными. Мониторинг закупок дает возможность отслеживать процедуры закупок на любом этапе их осуществления. Таким образом, исследование типичных нарушений в сфере публичных закупок и методы их выявления являются весьма актуальными.

EN: The article deals with typical violations in the field of public procurement and outlines the need to strengthen control in this sphere by preventing the offense, and not detecting it through the introduction of a new effective form of control – procurement monitoring. Transparency in the use of public funds is an indispensable feature of a democratic state, especially in the conditions of decentralization of power. Today Ukrainian society, there is a need for a systematic and reasoned analysis of the use of state resources. For a long time, public procurement was considered one of the most corrupt sphere in the economy. The public procurement procedure was of a paper nature, which made it impossible to monitor the transparency and efficiency of their implementation. The impetus for change was Eurointegration, when with greater vigilance, citizens began to pay attention to what exactly the funds in public institutions and organizations use. In this regard, our state has decided to modify this system and carry out reforms in this sphere, through the introduction of the electronic trading system, called “ProZorro”. Today the оne of the most pressing problems in Ukraine is the issue of control over public procurement, especially in the context of modern electronic procurement. In order to overcome corruption schemes in public procurement, it was decided to introduce the transition to electronic document circulation using the electronic trading system, known as “ProZorro”. The old forms and methods of control become incapacitated. Procurement monitoring provides an opportunity to monitor procurement procedures at any stage of their implementation. Thus, the study of typical public procurement violations and their detection methods are very relevant. In the article the most actual cases in which the rules of conducting the procedure of public procurement are violated are considered.
