Проблеми роботи зі службовою інформацією в державному діловодстві України : інституційно-правовий аналіз

Abstract

UK: У статті досліджуються правові аспекти регулювання службової інформації в Україні. Аналізується нормативно-правова база, що регламентує порядок віднесення інформації до категорії службової та використання грифу «Для службового користування» (ДСК). Виявлено суттєві невідповідності між прогресивними положеннями Закону України «Про доступ до публічної інформації» та застарілими підходами «Інструкції про порядок обліку документів з грифом ДСК». Також обґрунтовано необхідність реформування системи доступу до службової інформації відповідно до демократичних принципів прозорості та відкритості державного управління. Запропоновано шляхи вдосконалення нормативно-правового регулювання з метою забезпечення балансу між захистом службової інформації та реалізацією права громадян на доступ до публічної інформації.

EN: The article examines the legal aspects of regulating proprietary information in Ukraine. The author analyses the legal framework regulating the procedure for classifying information as proprietary and using the “For Official Use” (FOI) stamp. The author identifies significant discrepancies between the progressive provisions of the Law of Ukraine “On Access to Public Information” and the archaic approaches of the Instruction on the Procedure for Accounting for Documents with the DSK stamp. The author substantiates the need to reform the system of access to official information in accordance with the democratic principles of transparency and openness of public administration. The author suggests ways to improve the regulatory framework with a view to ensuring a balance between the protection of proprietary information and the exercise of the right of citizens to access public information. Despite the progressive nature of the norms of the Law of Ukraine “On Access to Public Information”, the practical application of these norms is complicated by the inconsistency of subordinate regulatory legal acts, in particular the Instructions on the procedure for accounting for documents marked “For official use”. The Instruction, which was adopted back in 1998 and only slightly updated after 2011, contains a number of provisions that contradict the principles enshrined in the Law. The issue of access to information held by state authorities is one of the key indicators of the democratic nature of society and the effectiveness of public administration. In the context of the development of the information society and European integration processes in Ukraine, the problem of ensuring a balance between the openness of information and its restriction in order to protect the legitimate interests of the state and society is of particular relevance. The purpose of the study is to analyze the legal aspects of regulating official information in Ukraine, identify contradictions between legislative acts and subordinate regulatory legal acts in this area, and develop recommendations for improving the system of access to official information in accordance with democratic principles and international standards.
