Світовий досвід реалізації конкурентної політики на ринку інформаційних технологій

Abstract

UK: У статті розглянуто конкурентну політику на ринку інформаційних технологій в контексті прискореної цифрової трансформації та глобальної конкуренції, що підвищує стратегічну важливість адаптивного державного регулювання для зміцнення національної конкурентоспроможності. Метою роботи визначено ідентифікацію та порівняння іноземних практик конкурентного регулювання ринку інформаційних технологій, а також його загального державного стимулювання; на основі цього було сформовано рекомендації для удосконалення конкурентної політики в Україні. На основі аналізу запропоновано для України поєднання «м’яких» і «жорстких» інструментів: регуляторні пілоти типу «пісочниць», інкубатори/акселератори з прозорим моніторингом ризиків; механізми саморегулювання/співрегулювання; а також використання можливостей, визначених у Ukraine Facility Plan (2025) – залучення університетів та бізнесу до створення центрів НДДКР та тристоронньої взаємодії «уряд-бізнес-університети».

EN: The article analyzes global approaches to implementing competition policy in the information technology (IT) market under conditions of accelerated digital transformation and intensifying global competition. It emphasizes the growing need for adaptive regulatory frameworks that balance state intervention and market dynamism to enhance national competitiveness. The research aims to identify and compare foreign practices of competitive regulation and state stimulation of the IT market, including US, EU, and Asian (China, Japan, South Korea, Singapore, India) models, and to propose directions for improving Ukraine’s competition policy. The methodological basis includes comparative, analytical, and synthesis methods. The study finds that the US competition policy increasingly integrates dynamic competition and innovation-driven regulation; the EU prioritizes digital fairness and long-term innovation through antitrust enforcement and open standards; while Asian economies demonstrate hybrid models combining strict control over market concentration with proactive instruments such as regulatory sandboxes, start-up accelerators, R&D tax incentives, and cooperative statebusiness-university initiatives. Based on cross-country synthesis, the author proposes that Ukraine adopt a mixed approach of “soft” (grants, incentives, incubators, sandboxes, co-regulation) and “hard” (antitrust enforcement, monitoring, transparency) policy tools. Particular attention is devoted to tripartite cooperation between government, business and academia to expand R&D capacity, improve innovation competitiveness, and prevent monopolization of market access. The findings contribute to the theoretical and practical framework of modern competition policy for digital markets and can serve as guidelines for institutional modernization of Ukraine’s antitrust and innovation ecosystem. Future research should assess the impact of regulatory sandboxes and mixed policy tools on innovation and test a tripartite cooperation model to expand R&D and market collaboration.
